Throughout these Terms, “we”, “us” and “our” refer to Kasper van Nuland, trading as KavanuSurf / Tahe Sport Portugal.
2. Scope
These Terms apply to purchases made through this website by consumers and business customers.
A consumer is an individual purchasing primarily for purposes outside their trade or profession. Certain statutory rights described in these Terms, including the right of withdrawal, apply only to consumers.
By placing an order, you confirm that you have read and accepted these Terms.
3. Products
We sell physical watersports products. We make reasonable efforts to present product descriptions, images, prices and availability accurately.
Product colours and appearance may vary slightly depending on the screen or device used. Minor differences that do not affect the product’s normal use do not constitute a defect.
All orders are subject to availability.
4. Prices
Prices are shown in euros. Prices for consumers include applicable Portuguese VAT unless clearly stated otherwise.
Delivery charges and any other applicable costs will be displayed before the order is submitted.
We may correct obvious pricing or product-information errors. If an error affects an order already placed, we will contact the customer before proceeding. The customer may then confirm the corrected order or cancel it for a full refund.
5. Orders and contract formation
After an order is placed, the customer will receive an electronic confirmation. This confirms receipt of the order but does not necessarily mean that the order has been accepted.
The sales contract is concluded when we confirm acceptance of the order or dispatch the products.
We may refuse or cancel an order when a product is unavailable, payment is not authorised, the information supplied is incomplete or incorrect, or there is a clear pricing or technical error. Any payment already received for a cancelled order will be refunded.

Payment services are provided by independent payment providers and may be subject to their own terms and privacy policies.
Orders will normally be processed after payment has been authorised or received.
7. Delivery
We deliver only to addresses in Portugal.
Estimated preparation and delivery times are provided on the Shipping, Returns and Right of Withdrawal page and during checkout. Delivery times may depend on product availability and are estimates unless a specific delivery date has been expressly agreed.
The customer must provide a complete and correct delivery address. Additional costs resulting from incorrect or incomplete information may be charged to the customer where legally permitted.
Risk of loss or damage passes to a consumer when the consumer, or a person designated by the consumer other than the carrier, receives the products.
8. Right of withdrawal for consumers
Consumers normally have the right to withdraw from an online purchase without giving a reason within 14 days after receiving the products.

This statutory right does not apply to business customers.
9. Faulty or non-conforming products
Consumer purchases are protected by the mandatory legal conformity guarantee applicable in Portugal. For new movable goods, we are generally responsible for a lack of conformity that becomes apparent within three years of delivery, subject to the conditions and remedies established by Portuguese law.
If a product is faulty, damaged on arrival or not as described, please contact us at info@kavanusurf.com and include the order number, a description of the problem and, where helpful, photographs.
Depending on the circumstances and applicable law, the available remedy may include repair, replacement, a price reduction or cancellation of the contract.
Commercial warranties offered by manufacturers do not restrict a consumer’s statutory rights.
Business customers must inspect products within a reasonable period after delivery and notify us promptly of visible defects. Consumer-specific rights do not apply to business purchases.
10. Proper use and safety
Customers must follow all product instructions, safety information and manufacturer recommendations.
Watersports involve inherent risks. Products must be selected and used appropriately for the user’s experience, physical ability, conditions and intended activity. Nothing in these Terms excludes liability that cannot legally be excluded.
11. Liability
We are not responsible for losses caused by improper use, failure to follow product instructions, unauthorised modification, normal wear and tear, or circumstances beyond our reasonable control.
For business customers, we will not be liable for indirect loss, loss of profit, loss of revenue or loss of business, except where such liability cannot legally be excluded.
Nothing in these Terms limits mandatory consumer rights or excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
12. Intellectual property
The website and its content, including text, images, logos and product information, are protected by intellectual-property rights. Content may not be reproduced or used commercially without prior permission from the relevant rights holder.
13. Personal data
Personal data is processed as described in our Privacy and Data Protection Policy.

15. Applicable law
These Terms are governed by Portuguese law.
For consumers, this choice of law does not remove any mandatory protection granted by the law that would otherwise apply. Disputes may be submitted to the competent Portuguese courts or to any other court or dispute-resolution body made available by mandatory law.
16. Changes
We may update these Terms when our services, payment methods or legal obligations change. The version applicable to an order is the version available when that order is placed.
